The ninth circuit court of appeals ruled on this week that it would reexamine the legal dispute concerning the president’s authority with an larger group of 11 judges. The court also overturned a earlier decision from a three-judge panel that had sided with the administration.

Legal Saga Over Troop Deployment

This legal directive represents the latest development in a long-running legal battle over whether the administration has the legal right and valid reason to send state military units in the city. Approximately two hundred troops have been in uncertainty since late September when the deployment effort was initiated in due to ongoing demonstrations.

The administration has argued that federal officials at the immigration center in south Portland were under attack, while local authorities maintain that municipal police have control of the circumstances.

Recent Legal Actions

The appeals court decision came after a federal judge in Portland issued two legal injunctions this month – one blocking the federalization of the state troops, and another stopping the deployment of any military personnel in Oregon, after efforts to circumvent the first order by calling up out-of-state forces.

On the previous day, the appeals court had temporarily suspended the initial decision – allowing command of state troops – but the subsequent injunction stayed effective, blocking the actual deployment of the troops.

The Tuesday decision means the issue will be heard “en banc” – with both rulings under consideration together – by a panel of eleven justices.
